Privacy policy
This privacy policy applies to and governs the collection, processing, management, and storage of personal data received by SIA RNF, hereinafter referred to as the Lessor, from a natural person — hereinafter referred to as the Tenant — who has provided their personal data to the Lessor via the website car4rent.lv for the purpose of receiving services.
For the purposes of this privacy policy, personal data refers to any information relating to the Tenant as an identifiable person or to the Tenant’s personal identity.
Consent to the collection, processing, storage, and use of personal data
By filling out information, including personal data, on the website www.car4rent.lv to receive the Lessor’s services, the Tenant agrees and accepts that the Lessor may collect, process, store, and/or use personal data in accordance with this privacy policy. When the Tenant gives their consent to the Lessor for the collection, processing, management, and storage of data, the Tenant retains the rights to correct and delete the personal data submitted to the Lessor. The Tenant has the right to withdraw their consent for data processing at any time (if consent is the legal basis for processing as indicated below) by sending a written request to the Lessor. The Tenant’s consent is considered received when the Tenant has confirmed that they have read the privacy policy. Withdrawal of consent cannot stop data processing that the Lessor performs based on other legal grounds.
Personal Data
By establishing a legal relationship with the Lessor, the Tenant agrees that the following personal data, individually or collectively, may be collected, processed, and managed for the purpose of identifying the Tenant: first name, last name, phone number, website URL, IP address, geographic location, registration date and time, browser used, email address, residential address, data from the electronic device used to access the website www.car4rent.lv, and other personal data submitted by the Tenant.
The Lessor collects, compiles, processes, manages, and stores the Tenant’s data submitted during the use of the website www.car4rent.lv. The Tenant’s personal data related to their location is obtained and processed only when the Tenant activates the website www.car4rent.lv. The collection of location data stops when the Tenant closes the website www.car4rent.lv.
Purpose of Personal Data Processing
The purposes of processing the Tenant’s personal data are:
• To provide the Lessor’s services;
• To communicate with the Tenant;
• To ensure the security of users of the website www.car4rent.lv;
• To prevent, detect, and investigate activities that are prohibited, illegal, or contrary to good practice, including controlling, identifying, and preventing criminal acts, such as fraudulent payments, protecting the Lessor’s property, and objectively investigating incidents;
• To notify about changes in the Terms and Conditions;
• To inform about special offers from the Lessor;
• To personalize and improve services;
• To protect the Lessor’s services and reputation.
Legal Basis for Processing Personal Data
The Lessor processes the Tenant’s personal data based on the following legal grounds:
• Establishment and performance of legal relations – to provide rental services upon the Tenant’s request;
• Compliance with regulatory requirements – to fulfill obligations imposed on the Lessor by applicable external laws and regulations;
• Consent of the Tenant – the data subject;
• Legitimate interests – to realize obligations between the Lessor and the Tenant or the Lessor’s legitimate interests arising from the law.
The Lessor’s Legitimate Interests include:
conducting business activities; providing rental services; verifying the Tenant’s identity before service provision; ensuring the fulfillment of obligations; preventing unjustified financial risks to its business, including conducting credit risk assessments before and during service provision; retaining Tenant’s applications for services, notes about them, other submissions, complaints, claims, and requests; conducting recorded communications with the Tenant to ensure service operation, maintenance, billing, and quality control; conducting recorded communications with the Tenant, if any, to organize the fulfillment of service contractual obligations; managing the Tenant’s user data on the website www.car4rent.lv; advertising the Lessor’s services; sending messages regarding service provision and information about other important events; ensuring corporate governance, financial and business accounting, and analytics; ensuring and improving service quality; managing payments; managing unpaid payments; and addressing government agencies, law enforcement authorities, and courts to protect its legal interests.
Processing and Protection of Personal Data
The Lessor processes and protects the Tenant’s data using modern technological capabilities and organizational, financial, and technical resources reasonably available to the Lessor.
Data Controller
The data controller for the processing of personal data is SIA “RNF”, Reg. No. (Lessor). The Lessor’s contact information regarding personal data processing matters is: info@car4rent.lv
Categories of Personal Data Recipients
• When data must be provided to a third party within the framework of a contract concluded by the Lessor to perform a function necessary for providing the service to the Tenant (for example, to a bank for payment processing, an information technology company for client data processing, an accounting service provider for payment information processing, etc.);
• With the Tenant’s clear and explicit consent;
• In accordance with the procedure established by the regulatory enactments in force in the Republic of Latvia, to persons who have made a legally justified request to the Lessor and who have:
Legal basis for the receipt of the Tenant’s personal data from the Lessor.
• For the protection of the Lessor’s legitimate interests, including, but not limited to, taking action in court or other state institutions against a person who has violated the Lessor’s legitimate interests;
• For the development of special offers tailored to the Client’s interests and the improvement of the website www.car4rent.lv.
Data Storage
• Conversation recordings with the Tenant – are deleted six months after the date of the recording.
• Data about services provided to the Tenant – are deleted five years after the last day of service provision.
• History of completed trips – is deleted five years after the last completed trip.
• In cases of suspicion of a criminal offense, attempted fraud, or providing false information – personal data is deleted 10 years after the last day of service provision.
• In cases of disputes related to payments, data will be stored as long as the claim is satisfied or the dispute claim period expires.
Tenant’s Rights to Access Personal Data
The Tenant has the right to receive information prescribed by regulatory acts related to the processing of his/her data by sending a written request to the Lessor. The Tenant has the right to request the Lessor to provide access to their personal data, as well as the right to request the Lessor to supplement, correct, or delete the Tenant’s personal data, or to restrict processing, or to object to the processing of the Tenant’s personal data.
To exercise their rights, the Tenant submits a written request to the Lessor. After receiving the written request, the Lessor verifies the Tenant’s identity, evaluates the request, and fulfills it in accordance with the regulatory acts in force in the Republic of Latvia. The Lessor sends a written response to the Tenant at the address specified in the written request or at the address the Tenant has provided to the Lessor.
Communication with the Tenant
The Lessor uses the contact information provided by the Tenant for communication: phone number, email address.
Changes to the Privacy Policy
The Lessor has the right to make unilateral changes to the privacy policy. The Lessor notifies the Tenant about changes to the privacy policy. The current privacy policy is available on the website www.car4rent.lv.
This version of the privacy policy comes into effect on 1.04.2023.
